Indonesia Strengthens Role in FIDIC Asia Pacific, Encouraging Fair Understanding of Construction Dispute

The importance of using FIDIC contracts or international contract models that are fair and balanced between users and service providers.

Konstruksi Media Indonesia is further strengthening its position on the international stage by actively participating in the Federation Internationale Des Ingenieurs-Conseils (FIDIC) Asia Pacific event, which will take place in Bali from August 18–20, 2025, organized by INKINDO (The National Association of Indonesian Consultant).

The event will bring together member associations from Asia-Pacific countries to discuss strategic issues in the construction sector, including fair and balanced dispute resolution. Chair of FIDIC Membership Committee, Enni Moeliati Soetanto, explained that Indonesia’s involvement is not only limited to presence, but also carries an important mission to prioritize the concept of dispute avoidance in the country.

“We want to provide an understanding that dispute resolution should be done through negotiation, not directly to the courts. This is more in line with our culture, and is also regulated in Law No. 2 of 2017 as an alternative dispute resolution,” said Enni in a conversation with Konstruksi Media on the sidelines of the Institution of Dispute Board for Construction (PADSK) and the Society Construction Law Indonesia (SCLI) International Conference 2025 held at the Manhattan Hotel, Jakarta, August 7–8, 2025.

She added that since 2017, Indonesia has been actively developing alternative dispute resolution, including through PADSK and SCLI. According to hher, the two organizations frequently collaborate to hold seminars, conferences, and construction law education programs.

“One important breakthrough was the establishment of a Master of Construction Law programme at Pekalongan University in 2023, which immediately received a positive response from state-owned enterprises (SOEs), ministries, and construction industry players,” she explained. Enni emphasized the importance of using FIDIC contracts or international contract models that are fair and balanced between service providers and users.

We hope that contracts in Indonesia will no longer be ‘one-sided.’ If rights and obligations are balanced, projects can be completed without legal issues in the future,” she added.

She stated that the Master of construction law programme at the University of Pekalongan is now a pioneer in Indonesia, with a rapidly increasing number of students each year. Enni hopes that graduates of this program will have a good understanding of contract regulations and risks, thus preventing legal issues that could lead to the criminalization of officials or contractors.
“Regarding the 2025 PADSK-SCLI International Conference, we simply want to share knowledge with the next generation, so they can manage projects professionally and ethically,” Enni concluded. (***)
